Do I need a CCTV policy for my business?
Yes. Any UK business operating CCTV that captures identifiable images must have a CCTV policy under the Data Protection Act 2018. The policy should explain why you use CCTV, how footage is stored and retained, who can access it, and how individuals can exercise their rights. Without a documented policy, you risk enforcement action from the ICO.
What is a DPIA for CCTV?
A Data Protection Impact Assessment (DPIA) for CCTV evaluates the privacy risks of your surveillance system. Under UK GDPR, a DPIA is required when processing is likely to result in a high risk to individuals — which CCTV monitoring almost always qualifies for. It should cover the purpose of surveillance, necessity, proportionality, and measures to mitigate risk.
How long can you keep CCTV footage in the UK?
There is no fixed legal maximum, but the ICO recommends retaining footage only as long as necessary for its stated purpose — typically 30 days for most businesses. You must document your retention period and have a process for securely deleting footage once the retention period expires.
Do I need to register CCTV with the ICO?
Yes. Most organisations operating CCTV must pay the ICO data protection fee, which costs between £52 and £78 per year depending on your organisation size. Failure to pay can result in enforcement action and penalty notices from the ICO.
What are the CCTV signage requirements in the UK?
Under the Surveillance Camera Code of Practice and UK GDPR, you must display clear signs informing people they are being recorded. Signs must include the identity of the data controller, the purpose of surveillance, and contact details for the data controller. Signs should be placed at entry points and be clearly visible before a person enters the monitored area.
Can employees request CCTV footage of themselves?
Yes. Under UK GDPR, employees can make a Data Subject Access Request (DSAR) for any CCTV footage containing their image. You have one calendar month to respond. You must provide the footage free of charge unless the request is manifestly unfounded or excessive. You also need to redact or blur other identifiable individuals in the footage before sharing it.
